Terms & Conditions

JP PROPERTY WORKS, LLC
TERMS AND CONDITIONS

Last Updated: September 20, 2026

These Terms and Conditions apply to all estimates, proposals, services, projects, material deliveries, and equipment services provided by JP Property Works, LLC (“JP Property Works,” “we,” “us,” or “our”). By approving an estimate, paying a deposit, scheduling services, or allowing work to begin, the customer agrees to the following terms.

  1. Estimates and Project Scope

All estimates are based on the information available at the time of inspection or request. An estimate includes only the labor, materials, equipment, and services specifically listed in the written proposal.

Any additional work, materials, disposal fees, delivery charges, site conditions, or customer-requested changes outside the original scope may result in additional charges. JP Property Works will communicate significant changes whenever reasonably possible before completing additional work.

Measurements and material quantities are estimates. Final pricing may be adjusted if actual site conditions or required material quantities differ substantially from what could reasonably be determined during the initial inspection.

  1. Estimate Approval and Scheduling

A project is not officially scheduled until the customer has approved the estimate and paid any required deposit. Requested dates are not guaranteed until confirmed by JP Property Works.

Scheduling may be affected by weather, equipment availability, material availability, disposal facilities, site conditions, emergencies, or other circumstances beyond our control. We will make reasonable efforts to notify the customer of delays and reschedule the work promptly.

  1. Deposits

A 50% deposit may be required when materials must be purchased in advance or when the total project estimate exceeds $2,500. JP Property Works may also require a deposit for specialty materials, reserved equipment, multi-day projects, or other work involving advance expenses.

Deposits are applied toward the total project balance. Once materials have been purchased, equipment has been reserved, or work has begun, the deposit may become partially or fully nonrefundable to cover expenses already incurred.

  1. Payment Terms

Unless otherwise stated in writing, the remaining project balance is due within 7 calendar days of substantial completion.

Payment may be made using an approved form of payment, including cash, check, or electronic payment. Credit and debit card payments are subject to a 2.5% processing fee.

Returned checks, disputed payments, late payments, or collection expenses may result in additional fees to the extent permitted by Georgia law. The customer is responsible for reasonable costs associated with collecting an unpaid balance, including filing fees, collection expenses, and attorney’s fees where legally permitted.

  1. Returning-Customer Discount

Eligible returning customers may receive a 10% discount when approved by JP Property Works. This discount may not apply to materials, disposal charges, subcontracted work, delivery fees, or other direct project expenses. Discounts cannot be combined unless agreed to in writing.

  1. Changes and Additional Work

Any request that changes the original scope of work may require a revised estimate or change order. This includes changes to the project size, design, materials, location, access requirements, grading, drainage, hauling quantity, disposal needs, or completion method.

Verbal or written approval of additional work may be treated as authorization for the related charges. When possible, JP Property Works will document changes through text message, email, invoice, or an updated proposal.

  1. Property Access and Customer Responsibilities

The customer agrees to provide safe and reasonable access to the property, work area, driveway, gates, utilities, and other necessary locations during the scheduled service period.

The customer is responsible for:

• Removing vehicles, decorations, furniture, toys, pet waste, and personal belongings from the work area
• Securing children and pets away from equipment and active work areas
• Identifying property lines, septic systems, irrigation lines, private utilities, invisible fences, drainage systems, and underground structures
• Obtaining any required neighborhood, HOA, landlord, or property-owner approval
• Informing JP Property Works of known hazards or access restrictions before work begins

JP Property Works is not responsible for damage to unmarked or undisclosed private lines, irrigation systems, septic components, invisible fences, cables, landscaping features, or underground structures that could not reasonably be identified.

Public utility-locate services do not ordinarily identify customer-owned private utility lines. Private locating services may be recommended or required at the customer’s expense.

  1. Permits and Approvals

Unless specifically included in the written estimate, the customer is responsible for determining whether permits, HOA approvals, property-owner approvals, or other authorizations are required.

JP Property Works is not responsible for delays, fines, or corrective work resulting from missing approvals or inaccurate information provided by the customer.

  1. Site Conditions and Unforeseen Circumstances

Certain conditions may not be visible until work begins. These may include buried debris, rock, unstable soil, excessive roots, underground structures, poor drainage, contaminated materials, hidden utilities, unsuitable fill material, or limited equipment access.

Additional labor, equipment, material, hauling, or disposal required because of unforeseen conditions may result in additional charges. JP Property Works may pause work if continuing would be unsafe, unlawful, or materially different from the approved project scope.

  1. Materials and Natural Variations

Natural materials such as gravel, stone, soil, mulch, plants, sod, and wood may vary in color, texture, size, moisture content, and appearance. These natural differences are not considered defects.

Material availability and appearance may also vary by supplier and season. If a selected material becomes unavailable, JP Property Works will discuss a reasonable substitute or scheduling adjustment with the customer.

  1. Landscaping, Plants, and Sod

The customer is responsible for watering, mowing, fertilizing, treating, and maintaining plants, grass, and sod after installation unless ongoing maintenance is specifically included in writing.

JP Property Works cannot guarantee the survival or appearance of plants, seed, grass, or sod affected by weather, drought, excessive rain, improper watering, disease, pests, animals, shade, poor soil, customer neglect, or conditions outside our control.

  1. Drainage and Grading

Grading and drainage services are intended to improve site conditions based on what is reasonably observable when the work is performed. Because rainfall, soil conditions, neighboring properties, underground water, and future land changes are outside our control, JP Property Works cannot guarantee that standing water, erosion, or drainage concerns will never occur.

  1. Hauling, Junk Removal, and Cleanouts

The customer must accurately describe the items or materials being removed. Pricing may change if the actual volume, weight, type, location, or accessibility differs from the information originally provided.

JP Property Works will not knowingly transport hazardous, illegal, explosive, radioactive, infectious, or otherwise prohibited materials. This may include certain chemicals, fuels, asbestos-containing materials, medical waste, ammunition, paint, batteries, and pressurized containers. The customer is responsible for disclosing potentially hazardous materials before service begins.

Additional landfill, transfer-station, tire, appliance, mattress, or specialty disposal charges may be added when applicable.

  1. Material Delivery

Delivery pricing is based on distance, material type, quantity, site accessibility, and supplier availability. The customer must provide a safe and suitable location for unloading.

JP Property Works may refuse to enter an area that appears unsafe, unstable, too narrow, too soft, or likely to cause damage or equipment entrapment. The customer accepts the ordinary risk of tire marks, surface impressions, or minor disturbance when heavy trucks, trailers, or equipment must enter unpaved, landscaped, soft, or wet areas at the customer’s request.

Once material has been delivered to the approved location, relocation or removal may require an additional charge.

  1. Equipment and Skid-Steer Services

Equipment services may be billed by the hour, by the project, or as otherwise stated in the estimate. Hourly services may include reasonable time for loading, unloading, setup, operation, and related work when specified.

The customer must provide sufficient access and identify any areas that cannot support heavy equipment. JP Property Works is not responsible for ordinary ground disturbance that is reasonably necessary to complete approved equipment work.

  1. Property Damage

JP Property Works will use reasonable care while performing services. The customer must report suspected damage promptly and allow us a reasonable opportunity to inspect the area before repairs are made by another company.

JP Property Works is not responsible for preexisting damage, normal wear, concealed defects, fragile surfaces, improperly installed improvements, unmarked underground items, weather-related damage, or damage resulting from customer instructions that conflict with our recommendations.

  1. Workmanship Concerns

Customers should notify JP Property Works of workmanship concerns within 60 days of project completion. We must be given a reasonable opportunity to inspect and, when appropriate, correct covered workmanship issues.

This does not cover normal settling, erosion, extreme weather, natural material variations, plant or sod survival, improper maintenance, misuse, alterations by others, customer neglect, or conditions outside our control.

  1. Cancellations and Rescheduling

Customers should provide as much notice as possible when canceling or rescheduling. Costs already incurred for materials, delivery, disposal, equipment reservations, subcontractors, or completed work remain the customer’s responsibility.

Special-order or custom materials may be nonrefundable. Repeated cancellations or short-notice changes may require an additional deposit before the project can be rescheduled.

  1. Weather Delays

Outdoor work is weather-dependent. Rain, storms, excessive heat, freezing conditions, wet ground, unsafe access, or other weather-related conditions may delay a project.

JP Property Works is not responsible for losses resulting from reasonable weather delays. Work will be rescheduled as soon as conditions and availability allow.

  1. Right to Stop or Refuse Work

JP Property Works reserves the right to stop or refuse work if conditions are unsafe, the requested work is unlawful, the customer interferes with safe operations, animals or individuals create a hazard, payment terms are not followed, or the work materially differs from what was represented.

The customer remains responsible for authorized work completed and expenses incurred before work is stopped.

  1. Photographs and Marketing

JP Property Works may photograph or record the work area before, during, and after a project for documentation, quality control, or marketing purposes. We will make reasonable efforts to avoid displaying personal information, addresses, license plates, or identifiable individuals.

Customers who do not want project photographs used for marketing must notify JP Property Works in writing before work begins.

  1. Limitation of Liability

To the fullest extent permitted by law, JP Property Works will not be responsible for indirect, incidental, special, or consequential losses arising from delays, property conditions, weather, supplier issues, hidden conditions, customer-provided information, or events outside our reasonable control.

Nothing in these Terms and Conditions limits any right or responsibility that cannot legally be limited under Georgia law.

  1. Governing Law

These Terms and Conditions are governed by the laws of the State of Georgia. Any dispute will be handled in the appropriate court or jurisdiction serving the area in which JP Property Works is located or the services were performed, unless otherwise required by law.

  1. Entire Agreement

The approved estimate, invoice, written change orders, and these Terms and Conditions make up the agreement between the customer and JP Property Works.

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply. Any exception or modification must be agreed to in writing.

  1. Acceptance

Approval of an estimate, payment of a deposit, scheduling of services, acceptance of delivery, or authorization for work to begin confirms that the customer has reviewed and accepted these Terms and Conditions.
